GARAGAAT VENDORS TERMS & CONDITIONS

(Buy and Sell of Used Cars)

1. GENERAL AGREEMENT

These Terms and Conditions apply to the sale, purchase, service and maintenance of used cars and items through Garagaat Vendors application.

Customers acknowledged having read and understood these Terms and Conditions by entering into any transaction with Garagaat Vendors.

2. SUBJECT MATTER VEHICHLE AND ITS CONDITIONS

The subject matter vehicles are used vehicles available for buy and sell at Garagaat Vendors application. They are listed on Garagaat’s website or mobile applications. However, all vehicles are subject to availability. It shall be confirmed upon receipt of the order from interested buyers/customers. Thus, Garagaat reserves its right to withdraw any vehicle from sale at any time;

Vehicles are sold under an “As-Is” basis unless otherwise specified in the sales contract or if warranty is provided by the customer;

The vehicle history or report pertaining to accidents, ownership history and service records for each car offered for sale is available;

Buyers are encouraged to inspect the vehicle personally or through a third-party mechanic before finalizing a deal or purchase;

A test drive may be arranged upon request. However, only authorized driver or persons with a valid driver’s license is allowed to do the test drive;

The value or the price listed on the vehicle is final unless otherwise agreed upon. The price is subject to applicable taxes, registration fees, and any additional charges such as financing or after-sale services;

Purchase price shall be paid in full at the time of the sale. However, financing or credit transactions are available. Its approval is subject to credit checks and terms set forth by the banks and other financing institutions;

4. VEHICLE WARRANTY & AFTER-SALES SERVICE

All used cars come with a limited warranty for a specific period as outlined in the sales agreement. The warranty coverage may include major components such as the engine, transmission, and electrical systems. Details of the warranty, including coverage, duration, and exclusions, will be provided at the time of sale;

No Warranty on certain parts. Certain parts, such as tires, lights, and minor cosmetic elements, may not be covered under the warranty. Specific exclusions will be outlined in the warranty agreement.

4. REGISTRATION AND OWNERSHIP TRANSFER

Vehicle’s registration will be processed through the appropriate local authorities. All registration or transfer fees are the responsibility of the buyer unless otherwise stated;

It is the buyer’s responsibility to ensure that the certificate of registration/title is properly transferred. He/she shall be responsible for any delays in the transfer process caused by incomplete documentation or his/her negligence;

Buyer shall ensure that the vehicle is insured from the time of purchase.

5. CANCELLATIONS & RETURNS

The sale transaction is considered final once the agreement has been signed. Hence, cancellation is no longer allowed;

Any significant defect not disclosed at the time of sale will entitle the buyer to a return or exchange of the subject matter vehicle. However, return or exchange policy will still be subject to the terms of warranty agreed upon and it must be initiated/enforced within the United Arab Emirates (UAE) law;

6. CUSTOMER RESPONSIBILITIES

Documentation: Buyers are required to provide valid documentation, such as identification and proof of address for the completion of the sale and transfer of ownership;

Payment of Fees: Buyers are responsible for the payment of any taxes, registration, and title fees associated with the vehicle;

Maintenance: Buyers are responsible for maintaining the vehicle as per the manufacturer’s recommended schedule of maintenance. Failure to maintain the vehicle may void any warranty;

Insurance: Buyers must arrange insurance for the vehicle upon purchase. The vehicle is not considered officially sold until insurance is secured.

7. LIABILITY AND LIMITATION

Liability Limitation: Garagaat Vendors’ liability for any claims, damages, or losses arising from the purchase or use of a used car is limited only to what is incorporated in these terms and conditions and the sales agreement;

Garagaat Vendors shall not be liable/responsible for any claims, damages, or losses resulting from the use, resale, or repair of the vehicle purchased from its application;

Buyers ensure that all used parts and wastes are disposed of in an environmentally responsible manner, in compliance with local laws and regulations.

A minimal amount of disposal fee may apply to ensure proper recycling of used wastes;

8. PRIVACY AND DATA PROTECTION

Personal Information: Garagaat Vendors collects and processes its buyers/customers personal information, such as the name, contact details, and credit information, in accordance with applicable data protection laws purposely to facilitate the purchase and financing of the vehicle;

Data Protection: Garagaat Vendors takes reasonable precautions to protect its buyer’s/customer’s data. It undertakes not to share it with third parties except as necessary to process payment, transfer of ownership, or fulfill the services requested.

9. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions are governed by the laws of the United Arab Emirates (UAE);

Any disputes arising from the purchase or use of a vehicle from Garagaat Vendors will be resolved through the courts of the UAE.

10. CHANGES OR MODIFICATIONS

Garagaat Vendors reserves the right to modify or update these terms and conditions at any time. Any changes will be posted on its website or communicated directly to customers;

Significant changes to these terms and conditions will be communicated to customers via email or through our website.
