GARAGAAT VENDORS TERMS AND CONDITIONS

on

CAR RENTAL SERVICES

1. GENERAL AGREEMENT

These Terms and Conditions apply to all rentals of vehicles from Garagaat, including reservations, payments, and use of the vehicle including the terms and conditions of the vendor.

Customer acknowledges and agrees to abide by these terms and conditions upon completion of a booking and/or signing the rental agreement.

2. VEHICLE RENTAL

Rental Period: The rental period starts upon pick up of the vehicle and ends when the vehicle is returned to the owner. The rental period and all applicable charges are based on the dates and times specified in the rental agreement;

Vehicle Availability: The vehicle chosen by the customer is subject to availability. Garagaat will make every effort to provide the model requested, but reserves its right to substitute a similar one;

Rental Fees: Rental fee will be based on the vehicle type, rental duration, and any additional services requested. It shall include basic rental costs but may exclude taxes, insurance, toll fees, fuel and any other expenses incidental to the usage of the vehicle rented;

Mileage Limitations: A standard mileage limit applies, as agreed by vendor the KM to used the car per day. If the usage exceeds the allowed mileage, an additional fee will be charged;

Minimum Rental Period: The minimum rental period depends on the needs of the customer. If the vehicle is returned earlier than agreed, no refund will be issued for the unused time;

7. EXTENDED SERVICES

Delivery and Pickup: Rental companies may offer delivery of the car to customer’s location or pick it up from the location of the customer at the end of the duration of the rent;

Fuel Options: Full tank at pick-up with an option to return it empty, or pre-purchase fuel options;

One-Way Rental: Allows customer to pick up a car at one location and drop it off at another;

Long-Term Rentals: Discounted rates for extended rental periods, such as a month or more.

Off-Road Vehicle Rentals: Specialized vehicles are available for rent;

8. RESERVATION AND PAYMENT

Booking Process: The reservation of a vehicle needs complete personal details, like: 1. Full Name; 2. Address (can be customer’s Condo or Hotel); 3. Contact Number(s) or email address; 4. At least 2 valid ID’s or a Passport, if available; 5. Proof of Billing (Hotel invoice, Credit Card Statement, Electric Bill, etc.); and Payment of the reservation fee;

Booking Confirmation: A confirmation email or SMS with the booking details of the customer will be received once the reservation has been processed;

Payment Methods: Rental payment may be made via credit/debit cards, bank transfer, & pay by link. Full payment is required at the time of booking or pick up of the vehicle unless otherwise agreed upon;

Security Deposit: A refundable security deposit is required at the time of vehicle pickup. The deposit will be refunded in full upon the return of the vehicle in the same condition as rented, with the fuel tank full (if applicable) and no additional charges incurred. The deposit amount varies based on the vehicle type and rental duration;

9. DRIVER’S RESPONSIBITIES

Eligibility to Rent: In addition to the above-mentioned personal details requirements of the customer, he/she must be at least 18 years of age;

The customer, if unable to drive, may hire a driver who possesses a valid driver’s license. An additional fee may be charged for every driver hired by the customer;

The customer shall be liable and responsible for the driver of the vehicle rented;

Driver’s License: A valid driver’s license of the driver must be presented at the time of rental. If the driver’s license is not in English or Arabic or other language, an International Driver’s Permit (IDP) may be required;

Use of the Vehicle: The vehicle may only be driven by the customer who possesses a valid driver’s license and his/her authorized additional drivers;

The vehicle must not be used for any unlegal, unlawful or prohibited purposes, including off-road driving, racing, or towing unless expressly authorized by Garagaat;

Fuel Policy: The vehicle is provided with a full tank of fuel and must be returned with a full tank. If the vehicle is returned not in full tank, a refueling charge will be applied based on the cost of the fuel filled up, plus an administrative fee.

10. INSURANCE AND LIABILITY

Insurance Coverage: The rental fee includes basic third-party liability insurance. This covers damage or injury to other persons or property in the event of an accident. However, it does not cover damages to the rented vehicle itself or theft.

Collision Damage Waiver (CDW): Customer can purchase additional coverage, such as Collision Damage Waiver (CDW), which reduces liability for damage to the rented vehicle. CDW coverage may have an excess/deductible amount that the customer will be liable for in the event of damage;

Theft Protection: Theft protection coverage may also be purchased to limit customer’s liability in the event of vehicle theft. If the vehicle is stolen and there is no theft protection, customer may be liable for the full replacement value of the vehicle;

Damage to Vehicle: Customer is responsible for any damage to the vehicle, including tires, windows, and undercarriage, whether or not there an additional insurance has been purchased;

Accidents and Claims: In the event of an accident, customer must immediately report the incident to Garagaat, vendors and to the local authorities. A police report is required for insurance claims. If the accident is not reported, customer may be held liable for the full cost of damages;

11. VEHICLE PICK-UP AND RETURN

Pick-up Location: The vehicle must be picked up preferably from Garagaat Vendor’s location or at the place agreed upon at the time of the booking. In certain cases, vehicle delivery or pickup may be arranged for an additional fee;

Return Location: The vehicle must be returned to the same location unless otherwise agreed in writing;

Return Time: The vehicle must be returned on the agreed return date and time. Late returns may incur additional charges, calculated based on the daily rental rate;

Late Return Fees: If the vehicle is returned late, additional charges will apply as follows:

  • Fees apply per hour as agreed;
  • If the vehicle is returned more than 24 hours late, the rental period will be extended, and additional charges may apply;

Vehicle Condition: The vehicle must be returned in the same condition as when it was rented, with no additional damage or excess dirt. A cleaning fee may apply if the vehicle is excessively dirty;

Fuel: The vehicle must be returned with a full tank of fuel. If the vehicle is returned with less fuel, a refueling fee will be charged at the cost of fuel plus an administrative fee.

12. CANCELLATION AND CHANGES

Cancellation: Cancellation made more than 24 hours before the rental start date will entitle customer of a full refund. However, a cancellation fee of AED 30 may be deducted from the rental fee paid;

Late Cancellations: Cancellations made within 24 hours of the rental start date may incur a cancellation fee of up to 5% of the total rental fee;

Booking Modifications: Modifications on rental dates and vehicle types are allowed subject to availability of the unit. It must be made at least 24 hours before the rental date starts. In case like this, customer may be liable for additional or modification fees;

13. CUSTOMER RESPONSIBILITIES

Legal Use: Customer must ensure that the vehicle is used legally and safely in accordance with all local traffic laws and regulations;

Traffic Violations: Customer are responsible for any fines, penalties, or charges related to parking, speeding, or other traffic violations incurred during the rental period;

Vehicle Maintenance: Customer must ensure that the vehicle is maintained properly during the rental period. Fluid levels, tire pressure, and other safety precautions should be checked before the vehicle is operated;

Tolls and Charges: Customer is responsible for any tolls, charges, or penalties incurred during the rental period;

14. LIMITATION OF LIABILITY

Limitation of Liability: Garagaat is not liable for any indirect or consequential damages resulting from the use or inability to use the rental vehicle, including but not limited to loss of income, damage to personal property, or personal injury;

Indemnification: Customer must hold harmless Garagaat, its employees, and agents from any claims, damages, or losses arising from the use of the rental vehicle, including any claims for damage to property, injury to persons, and/or fines resulting from violations of traffic laws;

Waste Disposal: Customer ensures that all used parts and waste is disposed of in an environmentally responsible manner, in compliance with local laws and regulations;

Disposal Fee: A minimal amount of disposal fee may apply to ensure proper recycling of used waste;

15. PRIVACY AND DATA PROTECTION

Personal Information: Personal information such as the name, email address, shipping address, and payment details of the customer are gathered purposely to process the booking and communicate concerning the transaction;

Data Protection: Garagaat takes all reasonable measures to protect customer’s personal data and ensure that it is used to facilitate the booking transaction and communication purposes;

Third-Party Disclosure: Customer’s personal information is kept only by Garagaat. It cannot be disclosed to third parties except to facilitate the booking transaction and in any event relative the transaction;

Taxes and Duties: Customer is responsible for any applicable taxes, customs duties, or import fees related to their purchase.

16. GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law: These Terms and Conditions are governed by the laws of the United Arab Emirates.

Dispute Resolution: Any disputes arising from the rental agreement will be resolved in the courts of the UAE.

All customers using or availing the services of Garagaat are bound to agree and comply the foregoing Terms and Conditions.
