1. GENERAL AGREEMENT
Application of Terms: These Terms and Conditions apply to all customers who purchase used auto parts from Garagaat Vendors.
Acceptance: By placing an order, making a purchase, or accepting delivery of any used auto parts, customer/client acknowledges having read, understood, and agreed to these Terms and Conditions.
2. PRODUCT INFORMATION
Types of Used Parts: We offer a wide range of used auto parts, including but not limited to: Engine components (pistons, cylinders, crankshafts, etc.); Transmission parts (gears, clutches, torque converters, etc.); Suspension components (shocks, struts, springs, etc.); Electrical parts (alternators, starters, ECUs, etc.); Body parts (doors, hoods, bumpers, fenders, etc.); Interior components (seats, dashboards, trim pieces, etc.); Brake system parts (calipers, rotors, pads, etc.); and any other automotive parts as may be available.
Condition of Parts: All used auto parts are sold in "as-is" condition. While we make every effort to accurately describe the condition of each part, customers should understand that used parts may show signs of wear, minor damage, or cosmetic imperfections that do not affect functionality.
Part Availability: Availability of specific parts may vary and is subject to stock on hand. We cannot guarantee the availability of any particular part until the order is confirmed and payment is processed.
Part Descriptions: We provide detailed descriptions and, where possible, photographs of each used part. However, customers are encouraged to contact us for additional information or clarification before making a purchase.
3. ORDERING AND PAYMENT
Order Process: Orders can be placed through our website, by phone, or in person at our location. All orders are subject to availability and confirmation.
Payment Methods: We accept the following payment methods: Credit card; Bank transfer; Cash (for in-person purchases); Pay by link; or any other payment method approved by Garagaat Vendors upon confirmation of the order.
Payment Terms: Payment must be made in full before the parts are shipped or released for pickup. For large orders or special arrangements, payment terms may be negotiated on a case-by-case basis.
Pricing: All prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed and confirmed.
4. SHIPPING AND DELIVERY
Shipping Options: We offer various shipping options, including standard shipping, expedited shipping, and local delivery (where available). Shipping costs will be calculated based on the size, weight, and destination of the order.
Delivery Time: Delivery times are estimates and may vary depending on the shipping method selected and the destination. We are not responsible for delays caused by shipping carriers or other factors beyond our control.
Risk of Loss: Risk of loss or damage to the parts passes to the customer upon delivery to the shipping carrier or upon pickup by the customer.
Inspection Upon Delivery: Customers are encouraged to inspect all parts upon delivery and report any discrepancies or damage within 48 hours of receipt.
5. RETURNS, EXCHANGES, AND REFUNDS
Return Policy: Due to the nature of used auto parts, all sales are generally final. However, we may accept returns under the following circumstances: The part received is significantly different from what was described or ordered; The part is defective or damaged in a way that was not disclosed; or The wrong part was shipped.
Return Process: To initiate a return, customers must contact us within 7 days of receipt and obtain a Return Merchandise Authorization (RMA) number. Parts must be returned in the same condition as received, with all original packaging and documentation.
Refund Policy: Refunds will be processed only for approved returns and will be issued in the same form of payment used for the original purchase. Shipping costs are generally non-refundable unless the return is due to our error.
Exchange Policy: Exchanges may be available for parts of equal or greater value, subject to availability and approval. Any price difference must be paid before the exchange is completed.
6. WARRANTY AND LIABILITY
Limited Warranty: Used auto parts are sold with a limited warranty against defects in material and workmanship for a period of 30 days from the date of purchase. This warranty does not cover normal wear and tear, misuse, or damage caused by improper installation.
Warranty Claims: To make a warranty claim, customers must provide proof of purchase and return the defective part for inspection. If the claim is approved, we will repair, replace, or refund the part at our discretion.
Limitation of Liability: Our liability is limited to the purchase price of the part. We are not responsible for any consequential, incidental, or indirect damages, including but not limited to labor costs, towing expenses, or loss of use of the vehicle.
No Other Warranties: Except as expressly stated herein, we make no other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
7. CUSTOMER RESPONSIBILITIES
Proper Installation: Customers are responsible for ensuring that all parts are properly installed by qualified technicians. Improper installation may void any warranty and could result in damage to the vehicle or injury.
Compatibility: Customers are responsible for verifying that the parts they order are compatible with their specific vehicle make, model, and year. We recommend consulting with a qualified mechanic before making a purchase.
Inspection: Customers should thoroughly inspect all parts upon receipt and before installation. Any concerns should be reported immediately.
Compliance with Laws: Customers are responsible for ensuring that the use of any parts complies with all applicable local, state, and federal laws and regulations.
8. LIMITATION OF LIABILITY
Garagaat Vendors' liability for any claim related to the purchase or use of used auto parts is limited to the purchase price of the part in question.
We are not liable for any indirect, consequential, punitive, or incidental damages, including but not limited to loss of profits, loss of use, or damage to other parts of the vehicle.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply in all cases.
9. WASTE DISPOSAL
Environmental Responsibility: Customers are responsible for the proper disposal of any old or replaced parts in accordance with local environmental regulations.
Recycling: We encourage customers to recycle or properly dispose of automotive parts and fluids to minimize environmental impact.
10. PRIVACY AND DATA PROTECTION
Personal Information: Garagaat Vendors collect personal information such as name, email address, shipping address, and payment details to process orders and communicate regarding transactions.
Data Protection: We take reasonable measures to protect personal data and ensure it is used only for order processing and communication purposes.
Third-Party Disclosure: We do not sell or rent personal information to third parties. However, we may share information with third-party service providers such as payment processors and shipping carriers to fulfill orders.
11. GOVERNING LAW AND DISPUTE RESOLUTION
Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates.
Dispute Resolution: In the event of any dispute, both parties agree to resolve the issue amicably. If a resolution cannot be reached, disputes will be submitted to the exclusive jurisdiction of the courts of the UAE.
12. CHANGES AND MODIFICATIONS
Modification of Terms: Garagaat Vendors reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on our website and will become effective immediately thereafter.
