GARAGAAT VENDORS TERMS & CONDITIONS

(Car Towing )

1. GENERAL AGREEMENT

These Terms and Conditions govern the use of the towing and shipment services provided by Garagaat Vendors.

Customers acknowledged having read and understood these Terms and Conditions by entering into any transaction with Garagaat Vendors.

2. SERVICES OFFERED

Car Towing: Towing services are available for both local and long-distance towing.

Car Shipment: Enclosed or open-air transport for vehicles over long distances, including international shipping are likewise offered.

Types of Towing Services:

Flatbed Towing – A tow truck with a flat, horizontal bed that the car is driven or winched onto for safe transport.

Wheel-Lift Towing – A tow truck lifts the vehicle by its wheels, typically used for smaller or lighter vehicles.

Hook and Chain Towing – An older method, using chains to pull the vehicle by the axles or frame (less commonly used now due to potential damage to the car).

Heavy-Duty Towing – For larger vehicles like trucks, buses, or RVs.

Motorcycle Towing – Specialized service to tow motorcycles safely.

Long-Distance Towing – Towing services for vehicles that need to be transported over a long distance.

Emergency Towing – Available 24/7 and often used for accidents or breakdowns.

Roadside Assistance Towing – Includes services like jump starts, tire changes, or emergency gas delivery, in addition to towing.

Common Towing Accessories/Options Offered:

Flatbed or Tow Dolly for Vehicles – Tow dollies can be used to lift the front or rear wheels of a car, helping to prevent damage during the tow.

Winch Services – Used to pull a vehicle onto the tow truck, especially if it’s stuck in a difficult position (mud, snow, etc.).

Tow Straps or Chains – Used for attaching the vehicle to the towing vehicle.

Tow Bar – A device that allows one vehicle to tow another (commonly used for towing smaller vehicles behind RVs).

Towing Dolly – A two-wheel towing device used for pulling vehicles with front-wheel drive, lifting the front of the car while leaving the rear wheels on the ground.

Lockout Services – Unlocking vehicles when keys are locked inside.

Jump Start Kits – Available for vehicle that needs a battery boost before it can be towed.

Fuel Delivery – Emergency fuel delivery to vehicle that runs out of fuel.

Flat Tire Repair or Tire Change – Tire repairs or change of a flat tire before towing.

Battery Replacement – Replacement of a dead battery if it's needed before towing the car.

Windshield Protection – Protective covers to safeguard windshields and other parts from debris during the towing services.

Additional Towing Services:

Vehicle Storage – Storage for vehicle being towed until customer is able to pick it up or arrange further repairs.

Long-Term Towing Contracts – Towing services are available to businesses or individuals who may need towing services frequently. In such case, Garagaat offers subscription services and discounts.

Insurance for Towing – Additional insurance coverage for vehicles during the towing process, including damage during transport.

Specialized Towing for Vehicles:

Low-Profile or Exotic Cars – Towing services that specialize in handling high-value, low-clearance, or exotic cars, ensuring no damage to occur.

RV Towing – Special towing for large recreational vehicles or trailers.

Heavy Equipment Transport – Towing services for construction machinery, large equipment, or specialized vehicles.

Extras During Towing:

Live GPS Tracking – Real-time GPS tracking of the vehicle during the tow, so customer can see its location and estimated arrival time.

Towing for Boats and Trailers – Specialized towing for boats or other recreational vehicles, such as trailers or campers.

Motorhome Towing – Specialized towing for motorhomes, whether for mechanical issues or accidents.

Flat Tire Removal – For vehicles with flats, tire removal service is offered, if necessary, before the tow.

3. CUSTOMER RESPONSIBILITIES

Vehicle Condition: Customer must ensure that the vehicle is in a roadworthy condition for towing or shipment. Garagaat Vendors reserves the right to refuse service for vehicles that are unsafe or undriveable.

Accurate Information: Customer must provide accurate and complete information about the vehicle, including its condition, dimensions, weight, and location.

Removal of Personal Items: Customer must remove all personal belongings from the vehicle before towing or shipment. Garagaat Vendors is not responsible for any personal items left in the vehicle.

Keys: Customer must provide the keys of the vehicle (if necessary) at the time of pickup or delivery. Failure to do so may result in additional charges.

4. FEES AND PAYMENT

Charges: Fees for towing and shipment services are calculated based on the type of service requested, distance, vehicle type, and any additional services.

Payment Terms: Advance payment is due in full at the time of service or as per the agreed payment schedule. Payment through website or app are accepted.

Non-payment: If payment is not received within the specified time, Garagaat Vendors reserves the right to charge late fees or withhold services until payment is made in full.

Refunds: Refunds are only available if a service is canceled at the instance of Garagaat Vendors or towing company.

5. SCHEDULE AND DELAYS

Appointment Schedule: Customer must provide adequate notice or appointment for scheduling a towing or shipment service.

Delays: Garagaat Vendors will make reasonable efforts to adhere to the scheduled pickup and delivery times. However, delays may occur due to weather, traffic, mechanical failures, or unforeseen events. Under that circumstances of delay, Garagaat Vendors is not responsible for any loss or inconvenience;

Force Major: Garagaat Vendors is not liable for failure to perform its obligations due to causes beyond its control, including but not limited to acts of nature, government actions, or accidents.

6. CUSTOMER WARRANTIES

Customer warrants ownership of the vehicle or that he/she has the necessary authority, as the agent of the owner, to enter into this agreement. Thus, hereby indemnifies the company against claim of any nature made by any party arising out of or related to the conclusion of this agreement and the vehicle towed.

7. COMPANY’S LIEN

Garagaat Vendors or the towing company will have a lien over the vehicle should the customer fails to pay the bill/charges for the services rendered.

Customer agrees that should the vehicle is not claimed by the within ninety (20) days from the date it is towed or the service charge and other fees are not settled within the said period after having become due, Garagaat Vendors or the towing company will be entitled, without further notice:

1. to sell the vehicle in such a manner and on such Terms and Conditions as it deems fit;

2. to apply the process of any sale after deducting all expenses thereof in payment or reduction of any amount due by the customer to the company (including storage charges), provided that any surplus will be paid over to the customer without interest immediately after the sale, if the customer’s address is known, and if not, upon demand made by the customer within 30 (thirty) days from the date of the sale;

The company will not be liable for any loss or damage to the vehicle attributable to the implementation of this clause.

8. LIABILITY AND INSURANCE

Liability Limitations: Garagaat Vendors is not liable for damages to personal property within the vehicle, or for any loss or damages during transit, except as covered by the insurance policy.

Insurance: Garagaat Vendors provides basic insurance coverage for vehicles in transit. However, this coverage may have limitations. For additional coverage, customer may need to arrange supplemental insurance.

Damage Claims: Any claims for damage to the vehicle must be reported at the time of delivery. Claims must be supported by photographic evidence of the damage.

Indemnification: Customer agrees to indemnify and hold harmless Garagaat Vendors, its employees, and agents from any claims, damages, or expenses arising from the use of services.

Environmental Disposal: All used parts are disposed of in an environmentally responsible manner in compliance with local laws and regulations.

Disposal Fee: A small disposal fee may apply to ensure proper recycling of used oil and parts.

9. CANCELLATIONS AND MODIFICATIONS

Cancellation: Cancellation of service is allowed at least 2 days prior to the scheduled service date. A cancellation fee may apply.

Modifications: Any modifications to the service, such as changes to the pickup or delivery time or vehicle details, must be communicated to Garagaat Vendors promptly. Additional charges may apply for changes made after the initial agreement.

10. PRIVACY AND DATA PROTECTION

Personal Information: Personal information is collected to provide the services, including name, address, contact information, and vehicle details.

Data Security: Garagaat Vendors takes reasonable measures to protect customer’s personal information.

Disclosure: Garagaat Vendors ensures that it will not share customer’s personal data with third parties except as necessary to provide the services and comply with legal obligations. In some instances, disclosure of personal information must be with the explicit consent of the customer.

Taxes and Duties: Customers are responsible for any applicable taxes, customs duties, or import fees related to their purchase.

11. DISPUTE RESOLUTION

Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the UAE.

Dispute Resolution: In the event of a dispute, Garagaat Vendors encourages customers to contact it directly to resolve the issue. If resolution is not possible, disputes will be resolved through court proceedings.

12. AMENDMENT TO TERMS

Garagaat Vendors reserves the right to amend these Terms and Conditions at any time. Changes will be posted on its website, and the updated terms will be effective upon posting.
